1. Definitions
Capitalised words which appear in this document shall convey the meaning which is hereby defined:
- “We“, “Us“, “Our“, “Ours“, “Ourselves“, also the “Company“, “Copyright Owner“, “Copyright Holder“, or “Licensor“, shall refer to Wizard Systems Ltd, a company registered in the Republic of Cyprus.
- “Service“, also the “Application“, or “Software“, shall refer to GeetAR, a property of Wizard Systems Ltd.
- “You“, “Your“, “Yours“, “Yourself“, shall refer to the individual who operates, uses, or accesses the Service.
- “Processor“, also “Service Provider“, shall refer to any natural or legal person, public authority, agency, or other body which stores and/or processes personal data on Our behalf.
- “Terms” shall refer to the Terms of Service.
- “Policy” shall refer to the entirety of this document, which serves as an addendum to the Terms.
- “Website“, also the “Service’s Website“, the “Application’s Website“, or “Our Website“, shall refer to www.wizardsystems.co/geetar and all web pages therein, which We control and which We use in order to disseminate information about the Service.
- “Licence“, also “Your Licence“, shall refer to the limited, non-exclusive, non-transferable licence which We grant to You to use the Service and the Website for personal use only, subject to the Terms and this Policy.
2. Personal Data which We Process
We follow the principle of data minimisation when processing Your data. To this end, We only process data which are required in relation to the legal bases and to the purposes laid out in Sections 3 and 4 respectively. More specifically, We or Our Processors process the personal which is listed herein.
2.1. Data Processed by Us When You Provide Them Directly
We process the following data which are provided by You directly, e.g. during Your registration to the Service:
- Your email address
- Your account password
- Your in-app preferences, such as preferences about how You want the Service to behave during augmented-reality (AR) sessions for playing the guitar
- Your bookmarked pieces. These are musical pieces, lessons, or practice sets which appear in Your List page, along with any preferences related to them
- Information about Your feedback on Your guitar-playing sessions, including the time and date when You contributed Your feedback
- Information about Your ratings on pieces which You have played, including the time and date when You contributed Your ratings
- Your email messages to Us, such as in relation to support, including any attachments which You may provide
- Your cookie consent preferences, which We use in the Website
2.2. Data Processed by Us During Activities which You Voluntarily Initiate
We process the following data when You use the Service to execute tasks such as enrolling to a subscription, launching an AR session for playing the guitar, or visiting the Website:
- Your internet protocol (IP) address
- Information about Your most recent use of the Service, such as the time and date You last signed in to the Service, and the time and date You last performed calibration using the Service
- Versions of the Terms and of this Policy which You have previously accepted
- Consents which You have given to Us in relation to processing Your data
- Information about Your guitar-learning progress, such as total number of sessions played and total guitar-play duration
- Log records about Your guitar-playing sessions, including times and dates of Your individual sessions, their durations, the titles and tempos of pieces which You played, and diagnostic information such as frame-rates achieved while using the Application
- Information about Your device’s camera, such as focal length
- Images captured by Your device’s camera. These are processed ephemerally by default: Unless You give Us Your explicit consent to store them for diagnostic purposes, these images are processed in your device and are discarded immediately
- Anonymised statistical information extracted via calibration. This information does not visually depict any portion of any image and cannot be used to identify You
- Information about Your purchase history, such as in relation to subscriptions which You may have bought, including subscription type and expiry date
2.3. Data Processed by Us Automatically
We process the following data automatically during Your use of the Service:
- Meta-data information related to Your device, such as manufacturer, model number, and operating system version
- Log records related to Your navigation within the Service, such as which pages You visit while using the Service and where You click, along with the time and date of such events
- Crash records related to Your use of the Service, including the time and date of events where the Service malfunctions
2.4. Data Processed by Our Processors Automatically
Our Processors process the following data automatically during Your use of the Service:
- Meta-data information related to Your device, such as manufacturer, model number, and operating system version
- The app used to install the Service on Your device
- The version of the Service installed on Your device
- Information about Our Processors’ software development kits (SDKs) used within the Service, including their version numbers
- Unique identifiers related to Your device and the provision of authentication services
- Unique identifiers related to the Service and the provision of cloud services
- Unique identifiers related to Your Google account (if You are signed in with Your Google account while using the Service) and the provision of augmented reality services
- Unique identifiers related to Your device (if You are not signed in with Your Google account while using the Service), and the provision of augmented reality services
- Performance and other diagnostic data about the Service, the SDKs used within the Service, and Your device, such as battery life, loading time, latency, and frame-rate
- Information related to the usage of the SDKs used within the Service, including application programming interface (API) calls
- Your IP address
3. Legal Basis for Processing Your Data
We follow the principle of lawfulness, fairness, and transparency when processing Your data. To this end, We use the following legal bases for processing Your data:

- Images captured by Your device’s camera (which are stored for diagnostic purposes, only with Your explicit consent)
5.2. Data Which Our Processors Store for a Few Weeks After Your Last Attempt to Sign In to Your Account Or For One Year After Your Last Access to the Website, Whichever Comes Last

The following data are immediately and permanently deleted as soon as You revoke Your consent from within the Application, or as soon as Your account is terminated:

- Images captured by Your device’s camera (which are stored for diagnostic purposes, provided You have given Us Your explicit consent)
5.5. Data Which We Store Until Your Account Is Terminated
You may terminate Your account with Us at any time. We also have the right to terminate Your account, subject to the clauses outlined in the
Terms of Service. Upon termination of Your account, whether instigated by You or by Us, the following data are immediately and permanently deleted:
- The version of the Service installed on Your device
- Versions of the Terms and of this Policy which You have accepted
- Consents which You have given to Us in relation to processing Your data
- Information about Your most recent use of the Service
- Your in-app preferences
- Your bookmarked pieces
- Information about Your device’s camera
- Information about Your guitar-learning progress

The following data are kept for up to six (6) years after Your account is terminated in order to help Us resolve any ongoing disputes with You, to protect Ourselves against legal claims, and/or to meet any other legal obligations.

6. Who We Share Your Data With
We follow the principle of data integrity and confidentiality when processing Your data. To this end We only share Your data with the following Processors, with whom We have established data processing agreements (DPAs). Where relevant and/or necessary We may also share Your data with Our affiliates, or with third parties during business transfers, under the provision that the clauses in this Policy will be binding to the party receiving Your data.
6.1. Data Which We Never Share Without Your Explicit Consent
We expressly emphasise that unless You give Us Your explicit consent, the following data are never extracted out of Your device and are never shared with anyone:

6.2. Data Shared with Cloud Services Providers
We rely on Google Cloud EMEA Limited for storing some of Your data, for providing authentication solutions, and for conducting analytics on an aggregate and anonymised basis. You can review Our DPA with this Processor at

- Meta-data information related to Your device
- The app used to install the Service on Your device

Depending on your device manufacturer and camera hardware, we may rely on Google Cloud EMEA
Limited for the provision of some augmented reality services. You can review Our DPA with this

- Unique identifiers related to Your Google account (if applicable) and the provision of augmented reality services

- Information related to the usage of the SDKs used within the Service
6.5. Data Shared with Payment Services Providers
We rely on Google Cloud EMEA Limited for processing Your transactions with Us. You can review Our DPA with this Processor at

6.8. Data Shared with Our Affiliates
We may share any of Your data listed in Section 2 with any of Our affiliates, in which case the party who receives Your data will be bound by the same clauses as the ones listed in this Policy.
6.9. Data Shared during Business Transfers
We may share any of Your data listed in Section 2 with a third party in the event where We undergo a business transfer, such as a merge with the third party or a business acquisition by the third party, in which case the third party will be bound by the same clauses as the ones listed in this Policy.
7. Location of Your Data
We follow the principle of data integrity and confidentiality when processing Your data. To this end We and Our Processors store and process Your data in trusted locations in order to ensure the provisions laid out in accordance with the data protection laws of the European Union (EU) and other jurisdictions.

We or Our Processors store and process the majority of Your data in the EU. This includes the following data:
- Meta-data information related to Your device
- The app used to install the Service on Your device
- The version of the Service installed on Your device
- Information about Our Processors’ SDKs used within the Service

One of Our Processors, Google Cloud EMEA Limited, which provides cloud services to Us, stores and processes some of Your data in the USA. Your data is transferred to the USA subject to SCCs which apply in addition to Our DPA with this Processor (as cited in Section 6.2) in order to comply with the EU’s data protection laws. One of Our Processors, Namecheap Inc., which provides web hosting services to Us, storeas and processes some of Your data in the USA. Your data is transferred to the USA subject to SCCs which are specified in Our DPA with this Processor (as cited in Section 6.5) in order to comply with the EU’s data protection laws. 7.3. Data Stored and Processed at Various Worldwide Locations
Some of Our Processors store and process some of Your data at various worldwide locations. Where Your data is transferred outside the EU, SCCs apply in order to comply with the EU’s data protection laws.
7.3.1. Data Stored and Processed by Google Cloud EMEA Limited
One of Our Processors, Google Cloud EMEA Limited, which provides email services and payment services to Us, stores and processes some of Your data at various worldwide locations, including but not limited to the EU and the USA. Where Your data is transferred outside the EU, SCCs apply in addition to Our DPA with this Processor (as cited in Section 6.3) in order to comply with the EU’s data protection laws. One of Our Processors, CookieYes Limited, which provides cookie consent management services to Us, stores and processes some of Your data at various worldwide locations. Where Your data is transferred outside the EU, SCCs apply as per Our DPA with this Processor (as cited in Section 6.7) in order to comply with the EU’s data protection laws. 8. Security of Your Data
We follow the principle of data integrity and confidentiality when processing Your data. To this end We and Our Processors use encryption technology to secure Your data, both at rest and in transit.
9. Consequences of Not Providing Your Data
All of Your data listed in Section 2 are required by Us or by Our Processors in order for Us to ensure the correct operation of the Service and its provision to You. In the event where these data are not made available in the first place (e.g. when You refuse to provide them directly as per Section 2.1) or where they are rendered unavailable (e.g. when You revoke Your relevant consent, or when You exercise some of Your rights in relation to Section 11), We may become unable to provide the Service to You. Such an eventuality does not affect Our right to receive payments from You in relation to any paid subscriptions to which You have already been enrolled (see
Terms of Service for more details).
10. Children’s Data
- Personal data which belong to minors of 13 years of age or older are covered by this Policy, under the condition that parental and/or custodian approval has been acquired before registration, and during use of the Service (see Terms of Service for more details).
- Children under 13 years of age are prohibited from using the Service. If You are aware that any child has used the Service please contact Us at support@wizardsystems.co in order to delete all relevant personal data. We may ask for proof of the relevant account-holder’s age before proceeding to delete any data.
11. Your Data Privacy Rights
You have rights related to accessing, rectifying, and erasing Your data. In addition, You have rights related to restricting Us from using Your data, to objecting against Our processing of Your data, and to the portability of Your data. These rights, along with details on how to exercise them, are outlined below.

You have the right to ask Us to disclose to You all the personal data which We store related to You. You may also ask Us to provide this information in a machine-readable format, such as a spreadsheet (see Section 11.6). We typically respond within 30 days of receiving such a request from You.
11.2. Rectification of Your Data
We follow the principle of data accuracy when processing Your data. To this end, You have the right to rectify Your data, if You believe that the data which We store about You are inaccurate. In such an event, You can rectify Your data as follows:

You may terminate Your relationship with Us by deleting Your account (which can be done via the Application’s Settings page). Keep in mind that relevant clauses in the
Terms of Service apply. In the event where You terminate Your account, the following data are immediately and permanently deleted:
- The version of the Service installed on Your device
- Versions of the Terms and of this Policy which You have previously accepted
- Consents which You have given to Us in relation to processing Your data
- Information about Your most recent use of the Service
- Your in-app preferences
- Your bookmarked pieces
- Information about Your device’s camera
- Anonymised statistical information extracted via calibration
- Images captured by Your device’s camera (which are stored for diagnostic purposes, provided You have given Us Your explicit consent)
- Information about Your feedback on Your guitar-playing sessions
- Information about Your ratings on pieces which You have played
- Your guitar-learning progress
- Crash records related to Your use of the Service

12. Changes to This Policy
- We reserve the right to amend, update, and/or change this Policy from time to time, for any reasons which We may deem appropriate, including but not limited to improving the Service and in order to adapt to new legislation.
- In the event of any upcoming change to the Policy, We will notify You by means of a pop-up message (which You will only be able to see while operating the Application) or similar, stating the date on which the new Policy comes to effect. We will issue this notification no less than seven (7) days before the new Policy comes to effect.
- Unless otherwise stated by Us, the new Policy becomes effective at Universal Coordinated Time (UTC) 00:00 of the date-of-effect communicated to You via Our notification.
